Terms of Service
1. Introduction
These Terms of Service ("ToS") govern the provision of Gameserver and VPS hosting services (the "Services") by Jiri Vitak, a sole trader with its registered office at Ametystová 702/46, Prague 5 Radotín, Czech Republic, identification number 21766177 (the "Provider").
2. Acceptance of ToS
By ordering and using the Services, the customer (the "Customer") acknowledges that they have read, understood, and agree to be bound by these ToS. The Provider reserves the right to modify these ToS at any time, and the Customer is responsible for regularly reviewing these ToS.
3. Services
The Provider offers Gameserver and VPS hosting services, which enable the Customer to use virtual servers and game servers for their own purposes. The Services include, but are not limited to, server rental, technical support, and maintenance.
4. Ordering and Payment
The Customer can order the Services through the Provider's website or by contacting the Provider directly. The Customer must provide accurate and complete information when ordering the Services. The Provider will send a confirmation email to the Customer upon receipt of the order. The Services will be activated after payment of the invoice.
The Customer agrees to pay the fees for the Services in accordance with the Provider's pricing policy, which is available on the Provider's website. The fees are payable in advance, and the Customer is responsible for paying all applicable taxes and fees.
5. Term and Termination
The Services are provided for an indefinite period. The Customer can terminate the Services at any time by giving the Provider a written notice of at least 30 days. The Provider can terminate the Services if the Customer breaches these ToS or fails to pay the fees.
6. Customer Obligations
The Customer is responsible for:
- using the Services in accordance with these ToS and applicable laws;
- ensuring the security and integrity of their data and passwords;
- complying with the Provider's acceptable use policy, which is available on the Provider's website;
- providing accurate and complete information to the Provider;
- paying the fees for the Services on time.
7. Provider Obligations
The Provider is responsible for:
- providing the Services with reasonable care and skill;
- ensuring the availability and security of the Services;
- providing technical support to the Customer;
- maintaining the confidentiality and integrity of the Customer's data.
8. Liability and Warranty
The Provider is liable for damages caused by its gross negligence or intentional breach of these ToS. The Provider's liability is limited to the amount of the fees paid by the Customer in the last 12 months.
The Provider does not warrant that the Services will be uninterrupted or error-free. The Provider is not responsible for any damages or losses caused by third-party actions or events beyond its control.
9. Data Protection
The Provider processes the Customer's personal data in accordance with the Czech Data Protection Act (No. 110/2019 Coll.) and the General Data Protection Regulation (EU) 2016/679. The Provider will not disclose the Customer's personal data to third parties without their consent, except as required by law.
10. Governing Law and Jurisdiction
These ToS are governed by and construed in accordance with the laws of the Czech Republic. Any disputes arising out of or in connection with these ToS will be resolved through negotiations or, if necessary, through the courts of the Czech Republic.
11. Final Provisions
These ToS constitute the entire agreement between the Provider and the Customer and supersede all prior or contemporaneous agreements or understandings. If any provision of these ToS is found to be invalid or unenforceable, it will be replaced by a valid and enforceable provision that achieves the same purpose.
By using the Services, the Customer acknowledges that they have read, understood, and agree to be bound by these ToS.
12. Non-Refundable Setup Fees
All setup fees associated with the provisioning of our services are non-refundable. This includes, but is not limited to, setup fees for dedicated servers, virtual private servers, cloud hosting, and any other services that require a one-time setup fee. Once a setup fee has been paid, it will not be refunded under any circumstances, including but not limited to, cancellation of service or termination of this agreement.
